The Care Act will come into effect in April 2015 creating a single modern piece of law for adult care and support in England. It will update complex and outdated legislation that has remained unchanged since 1948 including repealing the Chronically Sick and Disabled Persons Act 1970.

How will it impact on Occupational Therapists?

The Care Act will affect more than 2,500 occupational therapists who work in social care in England, whether in assessment and adaptation services, reablement or community care services, housing teams, care homes and other settings. Key aspects of the Bill include:

  • Enshrining the principle of wellbeing in law – assessments must consider a person’s needs how they impact on their wellbeing, and the outcomes they want to achieve
  • A focus on preventing or delaying the need for support
  • The introduction of a consistent, national eligibility criteria
  • Reforming care and support funding, including the creation of a cap on care costs.
  • Giving carers a legal right to support from their local council.
